Who Qualifies for the EB-2 NIW?

To qualify for an EB-2 National Interest Waiver, you must meet two sets of requirements:

(1) the EB-2 threshold, and

(2) the three NIW prongs established in Matter of Dhansar

  • You must either:

    • Hold an advanced degree (master’s or higher), or a bachelor’s degree plus at least five years of progressive experience; or

    • Demonstrate exceptional ability in your field through evidence such as publications, awards, membership in selective organizations, media coverage, significant work experience, or other recognized achievements.

In addition to meeting the EB-2 baseline, applicants must show that a waiver of the job offer and labor certification is in the national interest of the United States. USCIS evaluates this under three prongs:

  • Prong 1: Substantial merit and national importance

    Your work must have meaningful value (scientific, technological, cultural, economic, educational, entrepreneurial, policy-driven, or otherwise), and must contribute to an area that impacts the United States on a broader level.

    • Examples include: research that advances public health, technological innovation, energy or environmental work., important business development, or projects that address national or regional needs.

  • Prong 2: You are well positioned to advance your proposed endeavor

    You must show that your background, experience, and track record make you credible and capable of carrying out the work in your field.

    • Evidence often includes: publications, presentations, patents, awards, strong letters of recommendation, notable work history, funding, contracts, leadership roles, or a clearly defined plan for your future work.

  • Prong 3: On balance, waiving the job offer requirement is in the national interest

    Here, you demonstrate that your contributions are important enough that requiring an employer sponsor or labor certification would slow or hinder work that benefits the U.S. This can be shown through the importance of your past achievements, the potential impact of your future work, or the fact that your expertise is uniquely valuable and not easily replaced.
